These General Conditions and General Terms and Conditions of Sale exclusively regulate the purchase and sale carried out in the online store (reservations) of Colourtrip, between the end, consumer as the buyer and Colourtrip, Lda as a seller, and apply to all visitors to the website www.colourtrip.pt, as well as to all commercial transactions carried out through the online store.

 

3.2. Browsing the site www.colourtrip.pt is intended for private use only, so the reproduction, transfer, distribution, or storage of the contents of the online store without prior written authorization is prohibited for any purpose other than strictly personal use.

 

3.3 The insertion of links to our site for commercial purposes or without prior authorization from Colourtrip is expressly prohibited, and the use of the domain www.colourtrip.pt for abusive purposes will be subject to legal action by Colourtrip.

5.2. The photos and videos presented on the site are for illustrative purposes only. Therefore, we recommend that you consult the product details for better information about the characteristics of the items you intend to purchase.

 

5.3. Prices and product specifications are subject to change without notice. Despite Colourtrip’s maximum attention to keeping all information up to date, some products may have an incorrect price, so we will check prices whenever we process orders. If the product price is lower than the advertised price, we will refund the difference. If the price is higher, we will inform the end consumer by email and await their decision to accept the new proposal or cancel the order.

 

5.4. Approval of the purchase order or request presupposes that the buyer acknowledges and accepts Colourtrip’s General Conditions and General Terms and Conditions of Sale on the website www.colourtrip.pt.

 

5.5. All data recorded by Colourtrip prove the set of transactions carried out between the seller and the end consumer, and Colourtrip is responsible for archiving the electronic document in which the contract is formalized, undertaking to keep it accessible.

 

  1. CUSTOMER AND USER OBLIGATIONS

6.1. Any visitor to the Colourtrip site undertakes to comply with and respect these general conditions, observing, in particular, the following obligations:

– It is forbidden to introduce, store, or disclose defamatory, obscene, offensive, xenophobic content, and/or any other content that violates general principles of law and public order through the website www.colourtrip.pt

– Keep and do not disclose your password to enter the site to prevent third parties from accessing your account and personal data.

– Do not use false identities.

– Provide your correct personal data and contacts so that Colourtrip can properly process orders.

 

6.2. The end consumer is solely responsible for the accuracy of the personal data communicated to Colourtrip and undertakes to enter and inform of any changes through their registered account at www.colourtrip.pt .

 

6.3. Colourtrip disclaims any responsibility for any delay or inability to process the order resulting from an error or insufficiency of the data communicated by the end consumer.

 

  1. COMLETION OF THE ONLINE ORDER

7.1. To complete an order on www.colourtrip.pt  it is necessary for the user to have a valid and frequently used email account and to register as a Colourtrip customer by filling out the available online form. After registration, simply add all the products that the end consumer wishes to purchase to the virtual shopping cart, following all the steps of the purchase to complete it successfully.

 

7.2. Filling out an order on www.colourtrip.pt is very simple:

– Browse through the online store pages and find the products you want to purchase.

– Add the preferred products to the virtual shopping cart by clicking “Add to Cart.”

– When you understand that you have chosen what you want to buy, finalize the purchase by clicking “Checkout.”

– Then, fill in your personal details on a simple form.

– Next, choose the payment method.

– Review your order.

– Proceed with payment to confirm the order.

– Finally, you will receive an order confirmation via email.

– By selecting the “Exit” button at the end of the purchase process, your order is confirmed.

7.4. In case of non-confirmation of payment or non-compliance with these Terms and Conditions of Sale, Colourtrip reserves the right not to accept your order or to cancel it in whole or in part, even after its automatic confirmation.

 

  1. AVAILABILITY OF PRODUCTS AND ORDER CONFIRMATION/CANCELLATION

8.1. Colourtrip only processes an order placed by a customer after confirmation of the respective payment, so it cannot guarantee the availability of the items until the start of the said processing.

 

8.4. The fulfillment of all orders placed on the site is subject to the availability of the products Colourtrip tries to ensure that all items offered for purchase on the site are available. However, Colourtrip reserves the right not to accept any order or to cancel orders already confirmed for products that are impossible to fulfill. In the event of product unavailability, Colourtrip will immediately inform the end consumer of the partial or total cancellation of their order, with the buyer entitled to a refund of the corresponding amount paid.

 

  1. ORDER CONFIRMATION OR CANCELLATION

9.1. Colourtrip may not validate an order that does not have a guarantee of good collection, if the order is incomplete or incorrect, or if the ordered products are no longer available. In any of the cases mentioned, Colourtrip informs the end consumer via email that the sales contract was not fulfilled, and Colourtrip did not proceed with the sale, specifying the reasons.

 

9.2. If the products ordered on www.colourtrip.pt are not available at the time of your last access to the site, even after receiving the order confirmation, or when Colourtrip receives your order, the seller immediately informs the user of the unavailability.

 

**9.3.** If order and payment have been made for products that are subsequently unavailable, Colourtrip will refund the money paid for the unavailable items.

 

**9.4.** Colourtrip reserves the right to refuse any order, regardless of the reason, and is not responsible for any damage or cost. Colourtrip also reserves the right to cancel any purchase, even if it has already been accepted or confirmed by Colourtrip, particularly in the following situations:

– The information provided on the invoice is incorrect or unverifiable.

– The order is flagged by the site’s security systems as incorrect, irregular, or susceptible to fraud.

– Payment for the order is not received within 2 consecutive working days after the order is accepted.

– It is believed that the buyer cannot carry out this act.

– It was found that there was an error in presenting the product’s price.

– It is assumed that the order originates from a reseller.

 

**10. PAYMENT AND CANCELLATIONS**

**10.1.** No refunds will be provided after the start of the tour or service.

**10.2.** The cancellation of a booking with Colourtrip may result in the application of cancellation fees by Colourtrip, as outlined in the following paragraphs. Upon canceling any booking, the customer will be notified via email or phone regarding the total cancellation fees.

 

  1. a) If the cancellation occurs with a minimum advance notice of 7 consecutive days, there will be no cancellation fee.
  2. b) If the cancellation occurs with an advance notice between 3 and 5 consecutive days, the customer will incur a cancellation fee of 50%.
  3. c) If the cancellation occurs with an advance notice of 2 consecutive days, the customer will incur a cancellation fee of 100%.

 

  1. PAYMENT CONDITIONS AND SECURITY GUARANTEES**

11.1. Payment methods available will be presented on www.colourtrip.pt.

11.2. You can pay for your products using:

– Credit card or debit card.

– Personal Paypal account.

– Bank transfer, with all necessary instructions provided for this payment method (proof of NIB).

– Mbway (a mobile payment system in Portugal).

11.3. In payments made by credit or debit card, all data (such as card number, expiration date, or security code) will be sent to the company that provides remote electronic payment services, if they pay. These details will not be used by Colourtrip except for the necessary operations related to the purchase or refund, in case of reimbursement under the exercise of the right of return, or for communication to the police in case of fraud.

11.4. If the customer chooses to pay via multibanco (Multibanco), Colourtrip will only start processing the order after receiving the payment. Therefore, in this payment method, it is advisable to go to the Multibanco ATM as soon as possible to receive confirmation of your order as quickly as possible. If 2 consecutive working days pass after placing your order and no payment has been received, the order will be canceled.

11.5. We advise against attempting to make payment by any other method not specified on www.colourtrip.pt. If you do so, Colourtrip cannot assume responsibility for lost payment or any other damages that may result.

 

  1. ONLINE STORE AND TRANSACTION SECURITY**

12.1. The online store uses the latest and most robust security technologies available for encryption. All payment data you provide will be encrypted from the initial moment of the transaction until the moment the order is processed, and it will not be stored on any public server.

12.2. Even though we use highly advanced encrypted software, any payment transmitted over the Internet or by email carries some risks, particularly when the user does not take proper precautions and adopt responsible conduct.

12.3. Colourtrip cannot be held responsible for any damages resulting from the use of electronic means of communication, particularly damages due to failures or delays in electronic communication, cross-interceptions, or manipulations of electronic communications by third parties or by computer programs used for electronic communications or transmission of viruses.

 

  1. PRODUCT OWNERSHIP**

Colourtrip retains full ownership of the products until it has received full payment for all of these products.

 

  1. PRICES

14.1.** The prices of the products presented on the site include Value Added Tax (VAT).

 

  1. QUALITY AND WARRANTY

15.1. Colourtrip will only sell on www.colourtrip.pt articles of the highest quality and never of lower quality than those available on the market.

 

  1. ORDER CANCELLATION

16.1. If the customer places an order and wishes to cancel it, they must send an email to info@colourtrip.pt with at least 24 hours’ notice.

 

  1. VALIDITY OF PROMOTION OR COMMERCIAL CAMPAIGNS**

17.1. Promotional offers or commercial campaigns published on the site are only valid at the time they are displayed on the site and under the established conditions unless otherwise communicated on the site.

17.2. In the event of canceling a product purchased as part of a commercial campaign or promotion, only the amount spent on the purchase of the item to be returned or exchanged will be credited or awarded.

 

  1. LIABILITY

18.1. Colourtrip will only be liable for damages suffered by the customer if such damages result from breaches attributable to Colourtrip’s contractual obligations to the customer, or if liability arises from the relevant legal framework.

18.2. If the customer has suffered damages as a result of the site’s activity, Colourtrip’s liability is limited to damages to products and reasonable, verifiable costs incurred by the customer due to Colourtrip’s violation of these Terms and Conditions of Sale.

18.3. Colourtrip is not responsible for damages suffered by third parties as a result of the use of any of our products. Colourtrip cannot be held responsible for damages suffered by the buyer as a consequence of the improper use of our products.

18.4. Colourtrip is not responsible for damages resulting from incorrect information on the site.

18.5. All products marketed by Colourtrip comply with Portuguese and European legislation.

 

  1. INTELLECTUAL AND INDUSTRIAL PROPERTY**

19.1. All texts, comments, works, illustrations, artworks, and images reproduced or represented on the site are strictly reserved in terms of copyrights, as well as intellectual property rights, worldwide.

19.2. Therefore, under the Intellectual Property Code, the use of information is only permitted for private purposes, subject to special provisions, including more restrictive provisions included in the code of conduct.

19.3.Any total or partial reproduction or representation of the site, in whole or in part, and of the elements included in it, is strictly prohibited.

19.4. The trade names, trademarks, and distinctive signs reproduced on the site are protected under applicable legal provisions on intellectual property. Any total or partial reproduction of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the Colourtrip brand.

 

20.5. If you wish to use information or materials from the site, you need to obtain prior written permission from Colourtrip.

 

  1. APPLICABLE LAW

21.1. These Terms and Conditions of Sale and all disputes arising out of or related to these terms and conditions, including their validity, the use of the site, or any purchase on it, shall be governed by Portuguese law.

21.2. In the event of a dispute over the interpretation or execution of these Terms and Conditions of Sale, Colourtrip and the buyer undertake to make efforts to reach a friendly, fair, and appropriate solution, within a maximum period of 60 (sixty) days from the date of receipt of the communication directed for that purpose by any of the parties involved.

21.3 In the absence of an amicable solution, under the previous paragraph, and in the event of non-compliance with these Terms and Conditions of Sale, both parties determine that the competent court is the Ordinary Court of the District of Lisbon, with express waiver of any other jurisdiction.

 

  1. AMENDMENT OF THE TERMS AND CONDITIONS OF SALE OF THE ONLINE STORE

Colourtrip reserves the right to change these Terms and Conditions of Sale at any time. The buyer is subject to the principles and conditions in force on the date of their purchase unless the law or competent authority imposes any changes to them.

In the event of a dispute, the consumer may resort to this Dispute Resolution Entity.
